1. ORDERS:
By placing an order with Erqos Technologies P.C., the buyer agrees to these Terms & Conditions, together with any other policies referenced on our website, including our Return & Refund Policy.
Erqos Technologies may review, accept, reject, or cancel any order where necessary, including where an order contains incorrect information, pricing errors, unavailable products, suspected misuse, or terms that conflict with these Terms & Conditions or applicable law. Nothing in these Terms & Conditions limits any mandatory statutory rights that cannot be excluded under applicable law.
2. TITLE & DELIVERY:
Delivery dates are estimates and are not guaranteed unless expressly agreed in writing by Erqos Technologies.
Erqos Technologies may select the shipping method and carrier unless specific shipping instructions are accepted in writing. For business purchases, title and risk of loss pass to the buyer when the products are handed to the carrier. For consumer purchases, risk passes according to applicable consumer law.
The buyer is responsible for providing accurate delivery details and for any delays, failed deliveries, or additional costs caused by incorrect or incomplete shipping information.
3. PAYMENT:
Unless otherwise agreed in writing by Erqos Technologies, all orders must be paid in full before shipment. Erqos Technologies may accept or reject payment methods at its discretion. The buyer is responsible for ensuring that all payment information is accurate and authorized. Orders may be delayed, suspended, or cancelled if payment is not received, is reversed, is disputed, or cannot be verified.
4. RETURNS & REFUNDS
Return, refund, and exchange eligibility, as well as return shipping, customs, inspection, and any applicable restocking, retesting, or validation fees, are governed by our Return & Refund Policy.
Products must not be returned without written return approval and return instructions from Erqos Technologies.
5. LIMITED PRODUCT WARRANTY:
ERQOS TECHNOLOGIES WARRANTS THAT ITS PRODUCTS SHALL BE FREE FROM DEFECTS IN MATERIALS AND WORKMANSHIP UNDER NORMAL USE AND SERVICE.
THIS WARRANTY DOES NOT COVER DAMAGE, DEFECTS, OR FAILURES CAUSED BY INCORRECT WIRING, INCORRECT POWER SUPPLY, IMPROPER INSTALLATION, MISUSE, ABUSE, NEGLECT, LIQUID EXPOSURE, ELECTROSTATIC DISCHARGE, MECHANICAL DAMAGE, UNAUTHORIZED REPAIR, UNAUTHORIZED MODIFICATION, INCORRECT STORAGE, OR USE OUTSIDE THE PRODUCT SPECIFICATIONS.
IF A PRODUCT IS CONFIRMED BY ERQOS TECHNOLOGIES TO BE DEFECTIVE, ERQOS TECHNOLOGIES MAY, AT ITS DISCRETION, REPAIR THE PRODUCT, REPLACE THE PRODUCT, OR ISSUE A REFUND OR CREDIT.
PRODUCTS MUST NOT BE RETURNED FOR WARRANTY INSPECTION WITHOUT WRITTEN RETURN APPROVAL AND RETURN INSTRUCTIONS FROM ERQOS TECHNOLOGIES.
The liability of Erqos Technologies under this commercial warranty is limited solely to the repair, replacement, or issuance of credit, at the sole discretion of Erqos Technologies, for products that become defective within three (3) months after delivery to the buyer, provided that: (1) the defective items are returned to Erqos Technologies upon Erqos Technologies’ issuance of an RMA, with transportation charges prepaid by the buyer; and (2) Erqos Technologies’ examination of such item discloses to Erqos Technologies’ satisfaction that such defects have not been caused by improper handling, storage, testing, installation, incorrect wiring, incorrect power supply, abuse, misuse, neglect, repair, alteration, unauthorized modification, liquid exposure, electrostatic discharge, mechanical damage, or accident.
This commercial warranty does not affect any mandatory statutory rights that may apply under applicable law.
6. EXTENDED WARRANTY
In addition to the Limited Product Warranty, Erqos Technologies may provide extended warranty support for eligible products for an additional period of three (3) years from the date of purchase.
During the extended warranty period, Erqos Technologies may, at its discretion, repair or replace eligible products. Labor, testing, handling, return shipping, and any other applicable service costs may be charged to the buyer. Products must not be returned for extended warranty service without written approval and return instructions from Erqos Technologies.
The extended warranty does not cover damage, defects, or failures caused by improper handling, storage, testing, installation, incorrect wiring, incorrect power supply, abuse, misuse, neglect, repair, alteration, unauthorized modification, liquid exposure, electrostatic discharge, mechanical damage, accident, or use outside the product specifications.
Any repair or replacement performed under the extended warranty does not restart or extend the original warranty period, unless required by applicable law.
To the maximum extent permitted by applicable law, Erqos Technologies shall not be liable for any loss of profit, loss of revenue, loss of production, loss of use, downtime, business interruption, loss of data, installation or removal costs, third-party costs, indirect damages, incidental damages, consequential damages, or any other losses arising from the use, failure, repair, replacement, or unavailability of the product.
This extended warranty does not affect any mandatory statutory rights that may apply under applicable law.
7. LIFE SUPPORT DEVICES / WEAPONS / SAFETY HAZARDS
ERQOS TECHNOLOGIES’ PRODUCTS ARE NOT DESIGNED, TESTED, CERTIFIED, AUTHORIZED, OR INTENDED FOR USE AS COMPONENTS OF LIFE SUPPORT DEVICES, MEDICAL DEVICES, LETHAL WEAPON SYSTEMS, SAFETY-CRITICAL SYSTEMS, OR ANY UNLAWFUL OR HIGH-RISK APPLICATION WHERE PRODUCT FAILURE COULD RESULT IN DEATH, PERSONAL INJURY, SEVERE PROPERTY DAMAGE, OR ENVIRONMENTAL HARM.
It is the Buyer’s responsibility to exercise due diligence while using Erqos Technologies’ products. Buyer acknowledges: (1) having the required experience and skills to evaluate and use the products safely; (2) taking all necessary precautions for safe utilization of the products; (3) implementing appropriate fail-safe mechanisms, redundancy, supervision, and external safety protections where required; and (4) ensuring that the final application complies with all applicable laws, regulations, standards, and certification requirements.
Erqos Technologies disclaims any warranty or responsibility for such unauthorized, unsafe, unlawful, or high-risk usage, which shall be at Buyer’s sole risk, even if Erqos Technologies has been previously notified of such usage. Any prior knowledge, discussion, technical support, or communication by Erqos Technologies regarding such usage shall not constitute authorization, approval, certification, or waiver of this restriction, except where expressly agreed in writing by Erqos Technologies.
8. LIMITATION OF LIABILITY:
WHERE PERMITTED BY LAW, ERQOS TECHNOLOGIES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, COLLATERAL, CONSEQUENTIAL, OR BUSINESS-RELATED DAMAGES, INCLUDING LOSS OF GOODWILL, LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF PRODUCTION, LOSS OF USE, DOWNTIME, BUSINESS INTERRUPTION, LOSS OF DATA, INSTALLATION COSTS, REMOVAL COSTS, REPLACEMENT LABOR, OR THIRD-PARTY COSTS.
Where permitted by law, the total liability of Erqos Technologies to the buyer for damages for any cause whatsoever, and regardless of the form of action, whether in contract, tort, negligence, strict liability, warranty, or otherwise, shall be limited to the lesser of: (a) the amount paid by the buyer for the specific product or products that directly or indirectly caused the damages; or (b) €5,000.
The buyer assumes all liability for any damages arising from or in connection with the installation, integration, use, misuse, incorrect wiring, incorrect power supply, improper configuration, improper programming, modification, repair, or operation of the products by the buyer, its employees, contractors, customers, end users, or others.
9. GOVERNING LAW:
These Terms & Conditions, and any sale of products by Erqos Technologies, shall be governed by the laws of Greece, subject to any mandatory rights and protections that may apply under European Union law or other applicable consumer protection laws.
Any dispute arising from or relating to these Terms & Conditions, the sale of products, or the use of Erqos Technologies products shall be subject to the competent courts of Greece, unless otherwise required by applicable law.
If any provision of these Terms & Conditions is found to be invalid, unlawful, or unenforceable, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.
